Acceptance of Terms

By accessing or using the New Health Journal Institute (NHJI) website (the “Site”), including any content, features, or services offered on or through the Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Site.

Modifications to Terms

NHJI reserves the right to modify these Terms at any time, effective upon posting of the revised Terms on the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

Use of the Site

You may use the Site for lawful purposes only and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, provincial, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation
  • To impersonate or attempt to impersonate NHJI, an NHJI employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by NHJI, may harm NHJI or users of the Site or expose them to liability

Language of Services and Québec Restriction

All website content, programs, digital products, services, communications, customer support, and related materials provided by the organization are offered exclusively in the English language. The organization does not provide translations or services in any other language.

By accessing this website or registering for, purchasing, downloading, or using any of our programs, products, or services, you acknowledge and agree that you are sufficiently proficient in English to understand and be bound by all website content, instructions, agreements, and communications provided by the organization. If you do not understand English, you must not access or use this website or any programs, products, or services.

This website and the organization’s programs, digital products, and services are not offered to residents of the Province of Québec, Canada. This exclusion is intended to comply with Québec’s language-of-commerce requirements, as the organization does not currently have the resources to translate its content or provide support in French. By accessing this website or registering for, purchasing, downloading, or using any of our programs, products, or services, you represent and warrant that you are not a resident of Québec and are not accessing or using them from within Québec. The organization reserves the right to refuse service, cancel registrations or transactions, or terminate access where it reasonably believes a user is located in Québec.

Educational Content

NHJI provides educational health and wellness content including multimedia courses, articles, and general health and wellness assessments (“Assessments”). All content is for informational purposes only. Content including Assessments are not a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

By using content, you acknowledge and agree that:

  • The Assessments and other content are not medical tests and do not provide a medical diagnosis.
  • The results of the Assessments are for informational purposes only and should not be used as a substitute for professional medical advice.
  • You are over 18 years old or the age of majority in your jurisdiction.
  • You do not have any serious or life-threatening medical conditions.
  • You will consult with a physician or other qualified healthcare provider before making any decisions or taking any action based on the results of the Assessments or information in educational content.
  • NHJI is not liable for any actions or decisions taken based on the results of the Assessments or information in educational content.

The non-medical assessment technologies offered on this Site are developed, maintained, and administered by third-party providers. NHJI partners with these technology providers to provide service at reduced cost.

Providers retain all intellectual property rights to the assessment questions, algorithms, and technology. Both NHJI and partners make all reasonable efforts to avoid collecting personally identifiable health information. Where possible, data is anonymized to further safeguard user privacy.

Eligibility for Assessments: The Assessments are intended for use by individuals between the ages of 18 and 65 who are in generally good health and do not have any serious diagnosed medical conditions. By using the Assessments, you confirm that you meet these eligibility requirements. If you are outside of this age range or have any concerns about your health, please consult with a qualified professional before using the Assessments.

Use of Fees and Program Funding

NHJI is a registered Canadian nonprofit organization; program fees support our mission of advancing public health and wellness knowledge rather than generating profit for shareholders or individuals.

Where optional specialist support is offered, it is provided by qualified volunteers.

Fees for optional analysis packages, reports, and related products cover the technology infrastructure, data processing, and development required to generate and deliver personalized assessments at scale. Reports are produced using proprietary assessment technology developed with our technology partners, which allows NHJI to offer detailed, individualized analysis at a lower cost than one-on-one consultation.

Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by NHJI, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. NHJI makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site.

Limitation of Liability

To the extent permitted by law, NHJI (and our suppliers, partners, agents, and volunteers) will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability, or otherwise, and even if we’ve been advised of the possibility of damages in advance. Our liability (and the liability of each of our suppliers, partners, agents, and volunteers) to you or any third parties under any circumstance is limited to the greater of $100 USD or the amount you have paid us in the 12 months before the event giving rise to your claims. Some jurisdictions don’t allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above may not apply to you.

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Canada without regard to its conflict of law provisions.
