Acceptance of Terms

By accessing or using the New Health Journal Institute (NHJI) website (the “Site”), including any content, features, or services offered on or through the Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Site.

Modifications to Terms

NHJI reserves the right to modify these Terms at any time, effective upon posting of the revised Terms on the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

Use of the Site

You may use the Site for lawful purposes only and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, provincial, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation
  • To impersonate or attempt to impersonate NHJI, an NHJI employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by NHJI, may harm NHJI or users of the Site or expose them to liability

Health and Wellness Assessments

NHJI provides health and wellness assessments (“Assessments”) for informational purposes only. The Assessments are not intended to be a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

By using the Assessments, you acknowledge and agree that:

  • The Assessments are not medical tests and do not provide a medical diagnosis.
  • The results of the Assessments are for informational purposes only and should not be used as a substitute for professional medical advice.
  • You are over 18 years old or the age of majority in your jurisdiction.
  • You do not have any serious or life-threatening medical conditions.
  • You will consult with a physician or other qualified healthcare provider before making any decisions or taking any action based on the results of the Assessments.
  • NHJI is not liable for any actions or decisions taken based on the results of the Assessments.

The health and wellness assessments offered on this Site are developed, maintained, and administered by Nikola Institute (“NI”), a third-party provider specializing in assessment technology. NHJI partners with NI through their Pro Bono Program, which allows us to offer these assessments to you at a significantly reduced rate.

NI retains all intellectual property rights to the assessment questions, algorithms, and technology. Both NHJI and NI make reasonable efforts to avoid collecting personally identifiable health information. In the event of termination of this partnership, user accounts and associated data may be deleted by NI to protect user privacy. Where possible, data is anonymized to further safeguard user privacy.

Eligibility for Assessments: The Assessments are intended for use by individuals between the ages of 18 and 65 who are in generally good health and do not have any serious diagnosed medical conditions. By using the Assessments, you confirm that you meet these eligibility requirements. If you are outside of this age range or have any concerns about your health, please consult with a qualified healthcare professional before using the Assessments.

Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by NHJI, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. NHJI makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site.

Limitation of Liability

To the fullest extent permitted by law, NHJI will not be liable for any damages of any kind arising from the use of the Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Canada without regard to its conflict of law provisions.
